Liability Transfer Statutory Declarations
Sometimes a traffic notice is issued to the registered owner of the vehicle for an infringement that occurred when a different person was driving. The driver may be a friend of the owner, an employee of the company who owns the vehicle (car rental companies, or trucking companies) or the vehicle may have been stolen. The owner of the vehicle (or an authorised employee of the company who owns the vehicle) must make a statutory declaration to transfer liability to the driver.
When a client presents a pile of these at a service desk, each one must be administered individually – which can be time consuming.
It is recommended that if there are more than 10 liability transfer statutory declarations presented, that the client be encouraged to make a private appointment to see a Justice.
