Requesting photo ID from clients?
It is good practice for a JP to ask to see photo ID from a client. HOWEVER, if a client does not have photo ID a JP should NOT refuse to take an Affidavit or a Statutory Declaration or witness a signature. (see Manual P11)
Ask the client
“What is your name?”
“What is your address?” and
“What is your occupation?”
Remind the client that making a false statement to a Justice of the Peace is against the law and they are required to be truthful. Then administer the document in the usual way.
(In the case of an Affidavit or Statutory Declaration this information is recorded at the top and is part of what the client states is true.)
