Can a Statutory Declaration or Affidavit be taken by Audio Visual Link?

Some JPs will remember that we were able to complete these documents via an AV link eg Zoom during the Covid Pandemic. This was possible due to special legislation passed in 2020 to enable matters to be dealt with during lockdowns. However the COVID-19 Public Health Response Act 2020 has since been repealed

Please remember that the following documents cannot be signed electronically and JPs cannot use an AV link (eg Zoom) to administer these

  • a will or codicil to a will
  • powers of attorney
  • affidavits
  • statutory declarations
